I just called my lawyer friend, and he’s very clear: Trade Marks are not surnames. They should be used exactly as registered, and that can be enforced by the Trade Mark owner. Examples from history where this has been done: LEGO® ( Not Lego ), Coca-Cola ( Not Coca Cola, Cocacola ), Pepsi ( Not PEPSI ). He added: if ever openSUSE gets sued as OpenSUSE, the case would not even reach court.
