Microsoft Exposed: Android Claims Are Bogus, Says Barnes & Noble

I found this article rather interesting. Any thoughts on this? I am interested in seeing these two giant gorillas go at it. It’s just interesting to me that these are essentially two gorillas from two different industries getting ready to duke it out.

I’m very pleased to have given money to B&N (our family owns 3 Nook
devices currently). I hope they continue to stand up to Microsoft.

I wish Google (as the owner of Android) would join them.

I think they need to more visibly be defending Android - though maybe I’m

as far as i can tell they are being very quiet on this matter…i have
no idea what their Grand Strategy is but as a kid i heard the old folks
say to not poke a mountain lion with a stick!

maybe they are waiting (and hoping) MS (and Apple) will bring suit
against Android…

Google has some pretty deep pocket (and a bunch of might bright
folks)…even a Mac-MS combined suit would cost them both BIG money
against Google (who i think is quite confident they have the facts to
fight off Weak, Bogus & Frivolous no matter how much money they are
willing to throw at it.)

It has surprised me that (a) nobody seems to have gone after Google, but
instead after the manufacturers of Android devices, and (b) that Google
has opted to be very quiet. Hoping that they’re preparing something.

Problem i see is this.
In todays world everyone is suing everyone and its not just narrowed to
MS or Apple. If Google know what patents they actually have they will
join the club as well. Thats just how it is.

On the other side it appears that MS is patent trolling which is very
funny and entertaining.

Thats why i think i am correct that patents ruin the world and should
be limited. Where a patent is, there is no innovation which one can see
on Windows anyway. (it is of course oversimplified)

Will MS now go after Amazon as well which is clearly the leader in
cloud computing.

It will be interesting for sure what future will hold with all this. I agree that patents and more so, lawyers are detrimental to innovation and creativity. I know of a very smart man that invented a machine for dispensing pharmaceuticals that was really quite innovative, compared to what automated machines already existed. He was in the late testing stages with one or two machines working in “the field” when he was sued and basically financially destroyed. The patents claims on that were, from my perspective bogus but when you have a smart inventor without deep pockets, big business seems to like to destroy innovation. That tells me that laws and practices really need to change in this highly bureaucratic society of which we live. I would like to see more little guys succeed out there. Though, Barnes and Noble are by no means the little guy, they just seem to be on the side of all the little guys out there.

Although I own a Kindle, I want to buy a Nook, just to show my support.

This is just a bi-product of the expense of litigation, in particular in the US. If a legal case has enough merit to not get thrown out immediately, then there is an expensive discovery phase, in which every potentially relevant document from both corporation are handed over, and all relevant people are deposed, which is basically being in the witness stand only outside of court. Then you go to trial, then to appeal. Depending on the appeal, you might do it all over again.

If these litigation expenses would be, say, $10 million, and you have Microsoft, who you know can afford the litigation without much trouble, saying “give me $5 million”, it’s just horse sense to pay and be done with it. Of course those numbers are arbitrary, the real ones are probably quite a bit higher. But with Google itself, they are probably looking for a fight, so the threat won’t work. And yes if it goes to trial, both sides in a way lose the litigation expenses, but Microsoft has tens of billions in the cash, and litigation won’t put a dent in that. And, they could potentially win. As a defendant, best case scenario you only have to pay the litigation expenses.

This is not particular to this industry, an action with enough merit to clear the early procedural dismissal motions, has value even if they would not ultimately be a winning case. Doing it with personal injuries is I guess called, “ambulance chasing”, and now I guess doing it with multinational tech corporations is called “patent trolling”.

Anyhow, we’ll see what happens, statements to the press from the parties in these things have to be taken with a grain of salt. I think they are just haggling over a number, but time will tell.

Google could handle taking Microsoft to court for a loooong time which really reduces the return on “investment”. These others not only don’t have the same funds to outlast a fight, they have to keep competitive against the other handset makers and keep consumer confidence. If they pay and move on while a competitor fights… then the competitor’s money is going into fighting and it’s an opportunity to leap ahead of them while they are in legal wranglings!

From the couple pieces I’ve read about the Google vs Oracle case regarding Java, Google’s legal team is pretty darn good. They are probably going to at least watch the B&N fight closely, and look for chinks weaknesses in the Microsoft argument.

It’s usually the quiet ones you have to be careful of. They know not to reveal their plans, or say anything that will hurt their case!

At least that’s my guess.

to me, all of this MS legal maneuvering just looks like a cornered rabid
skunk trying to get out with his skin intact…

they have lost the technology battle, face an ever declining user base
and are now trying to make loads of money with their legal department,
before they all retire and buy Apples running Linux, or smart phones
running Android.

I don’t know about you or others, but I’m more interested in the outcome
of the entire conflict rather than individual battles.
