emacs on 13.1 and ATI-fglrx looses boundary and is not resizable

after my yesterdays upgrade (net-repos) form 12.3 to 13.1 I have the following issue with my emacs:

when opening emacs (gnu emacs 24.3.1 on x86_64 with GTK+ 3.10.2) it first appears correct including the headline with the buttons for closing and resizing and a visible minibuffer. However as soon as I move the mouse over the window the line with the buttons and the minibuffer disappears and the window resizes to the content (without the minibuffer)

Resizing of the window by grabbing the frame is no longer possible.
