Now that Novell is part of Attachmate what is the status of the “Microsoft patent deal”?

I have actually not seen any information that deals explicitly with this issue. I’m only interested in whether the agreement is still in effect, not trying to initiate any discussions concerning the ethics associated with it.

One of the things I read (don’t have a link ATM) is that M$ has to return some of the patents.

To the best of anyone’s knowledge, there has been no change regarding the
collaboration agreement.

When a merger or acquisition takes place, generally all contracts are
left in place as part of the deal; they may be reviewed as part of legal
due dilligence, but when there’s no announcements made, it’s best to
assume the agreements have stayed in force.

Note: This is my opinion; not necessarily the opinion of anyone with a
legal background or with standing to comment on the contract itself. I

Jim. I think what you said makes very good sense. Since I personally don’t know what Knurpht is referring to at the moment I think I’ll just function on the basis of that unless I explicitly hear otherwise.

I think that’s a different deal, I’m pretty sure Scott was talking about
the ‘controversial’ Novell/MS agreement from a few years ago, not the
patent purchase agreement that came along during the negotiations between
Novell and Attachmate prior to that acquisition going through.

The Novell Attachmate deal’s patents (those that went to CPTN Holdings,
that is) weren’t ever disclosed to my knowledge.

The Novell-MS deal wasn’t about a patent sale, but patent indemnification
for customers who were concerned about that sort of thing, and a cross-
licensing deal IIRC.
