can anyone explain why when i open vlc it overlaps my panel on the bottom left, but clears if i hover my mouse over the effected area

That’s a bug in the task manager applet.
It happens with other programs as well under certain circumstances.
so it it something we just have to live with? i noticed it in the previous version. im on 13.1 now
Not necessarily.
You can live with it and pray it will get fixed some day.
Or you can report it at http://bugs.kde.org/
(Or since this is open source, you could even fix it yourself or find somebody to fix it

You mean on openSUSE 12.3?
But which KDE version? 12.3 included KDE 4.10, but the task manager was completely rewritten for 4.11. I don’t think I saw that particular bug in 4.10…
